    Das Fremde als das Eigene : Entstehung der südkoreanischen Wirtschaftskultur durch fremdbestimmte Modernisierung
    This thesis tries to search for historical origins of two salient features of South Korean economic culture: authoritarianism and particularism. Contrary to prevailing opinion that these features originated from Confucianism, which was the state ideology in the Chosun dynasty, this work contends that they are rather influenced by the way how the country was modernized under foreign influences since the end of 19th century. Social Darwinism, Japanese colonial rule and Korean War caused by separation of the Korean peninsular by two foreign powers Soviet Union and USA have on the one hand fostered authoritarian view of state and society. On the other hand the injustice done by the colonial and Korean state has induces the Korean populace to mistrust the state and its official legal system, which fostered particularistic practices like sectionalism, cronyism and corruption.

    MARPOL - Technische Möglichkeiten, rechtliche und politische Grenzen eines internationalen Übereinkommens
    Ziel des Internationalen Übereinkommens von 1973 zur Verhütung der Meeresverschmutzung durch Schiffe in der Fassung des Protokolls von 1987 (MARPOL 73/78) ist die Reduzierung des Eintrags von Schadstoffen in das Meer durch die Schifffahrt. Dies soll durch umfassende schiffbauliche Vorschriften, Ausrüstungsverpflichtungen, Betriebsvorschriften und Einleitungsverbote gewährleistet werden. Die Vertragsparteien des Übereinkommens verpflichteten sich, die Vorschriften zum Meeresumweltschutz auf die unter ihrer Hoheitsgewalt betriebenen Schiffe anzuwenden. Die Arbeit zeigt die Schwierigkeiten bei der Anwendung des MARPOL-Übereinkommens auf und verdeutlicht, welche Grenzen einem umfassenden, internationalen Vertragsrecht gesetzt sind, wenn die Anwendung den Vertragsparteien überlassen wird und somit ein großer Spielraum für den Einfluss von Wirtschaft und nationaler Politik besteht. Das MARPOL-Übereinkommen gilt weltweit gleichlautend für alle Vertragsparteien. Aus der Sicht des Umweltschutzes überwiegen die Vorteile dieser weltweiten Anwendung. Allerdings bringt diese auch Probleme mit sich, die bei der Auslegung der einzelnen Normen des Übereinkommens beginnen. Nicht nur die fortschreitende technische Entwicklung, auch bereits der heutige Stand der Technik kann eine Reduzierung der Schadstoffeinträge ermöglichen. Die Mehrheit der Reeder rüstet ihre Schiffe jedoch nur mit den vorgeschriebenen Anlagen aus, da sie kaufmännisch denken und handeln und sich aus freiwilligen, zusätzlichen Umweltschutzmaßnahmen keine direkte Gewinnsteigerung ergeben muss. Der Einfluss der Reeder auf Beschlussfassungen der IMO hat dazu geführt, dass es sich bei den MARPOL-Vorschriften nur um Mindeststandards handelt. Deutlich wird dies etwa an der Tatsache, dass durch MARPOL die Einleitungen von Schadstoffen unter bestimmten Bedingungen legalisiert sind und nur teilweise vollständig verboten wurden.

    Meister in sich verändernden Zeiten. Der Große Befähigungsnachweis zwischen deutscher Tradition und EU-Binnenmarkt
    The major certificate of aptitude (MCA) means that German craftmen have to pass an examination for the master craftsman`s certificate to start up a business of their own. This requirement has existed for centuries and is disputed since.Whereas in pre-industrial times this requirement was justified with "subsistence" the emphasis nowadays is based on the high performance which garantuess good qualitiy.In the course of the completion of the EUropea Union`s internal market as well as a chancing world of work the MCA was critcized again. The meaning of this master qualification is dubious in two ways: firstly, are German craftsmen Thus better than their European colleaques and secondly, does the examination that had been passed long ago still fulfill the latest requirement of the world of work?This survey shows, that the MCA makes sense in trades, in which flaws can be recognized years later. As a rule master craftsmen shows a much more detailed specialized knowledge.

    ‘That is My Profession’: occupational culture and occupational identities of seafarers in the global merchant fleet.
    Against the specific structural background of globalized shipping as a largely globalised industry which is strongly characterised by strict hierarchies and an authoritarian management style as well as ethnic segmentation and a pronounced male dominance of the workforce, I ask in this ethnographic dissertation about the construction of occupational identities and the corresponding boundary-work of seafarers on internationally crewed merchant ships. Concrete questions are: How do seafarers establish their occupational identity through boundary-work in everyday interactions? How are inclusions and exclusions negotiated with regard to membership of the practice community? What is the significance of cultural representations of the professional image of seafarers and other public discourses?Which intersectionalities with other identitarian attributions such as nationality, gender, class, etc. are important in this context? What role do the specific traditional organisational structures of the industry play in these identity constructions and boundary processes? I follow a theoretical framework which is formed by theories of the interactive negotiation of identities in the sense of the boundary-approach, as represented by Michèle Lamont and Andreas Wimmer. The present dissertation contributes new perspectives to the research on occupational culture in globalised shipping. Firstly, I was able to show, in favour of a process-based approach, that previous studies which set 'culture' as a given external 'factor' and only examine its effects on occupational culture fall short. Secondly, I have extended the debate about the ship as a "social place" (total institution, heterotopia, hyperspace) by a critical postcolonial perspective. Thirdly, I take up the question posed by Heide Gerstenberger and Ulrich Welke about the existence of a "transnational occupational culture" and come to conclusions that extend their findings by new perspectives. In terms of labour force, the shipping industry is characterised by a largely globalised labour market for seafarers, with international power relations in the world system being reflected in the organisational hierarchy on board ships. Another characteristic feature of this field is the traditionally very pronounced male dominance in maritime occupations. In addition, the field is characterised by particularly strict organisational hierarchies compared to other jobs and the survival of a bureaucratic management style that is considered to have been overcome according to the prevailing management discourse. Against this structural background, my dissertation investigates the construction of professional identities and the corresponding boundary-work of seafarers on internationally crewed merchant ships. Concrete questions are: How do seafarers and their identity constructions situate themselves in the cultural context of the ship's crew or industry? What is the significance of cultural representations of the professional image of seafarers and other public discourses? How do seafarers establish their occupational identity through boundary-work in everyday interactions? How are inclusions and exclusions negotiated with regard to membership of the practice community? Which intersectionalities with other identity attributions such as nationality, gender, class, etc. are important in this context? What role do the specific traditional organisational structures of the industry play in these identity constructions and boundary processes? I was able to gather the empirical material for working on the research questions in a participating observation of seven weeks on a container ship with an international crew. In addition, I rely on earlier (auto-ethnographic) observations that I made as part of the field during my training as a nautical officer and my subsequent professional activities in the industry, as well as on interviews with seafarers on board and ashore. I accompanied the analysis of my material by regular participation in an ethnopsychoanalytical interpretation group. The theoretical framework is formed by theories of the interactive negotiation of identities in the sense of the boundary-approach, as represented by Michèle Lamont and Andreas Wimmer. This theoretical approach has, first of all, the advantage over the ethnomethodological approaches of "doing difference" (West, Fenstermaker et al.) of overcoming their occasionalism considering the significance of macro structures. Secondly, the boundary-work approach is linked to a processual concept of culture (Martin Fuchs, Andreas Wimmer) which is able to overcome the weaknesses of a statically reductive classical concept of culture, such as the one that underlies current approaches to "intercultural management". The present dissertation contributes new perspectives to the research on occupational culture in globalised shipping. Firstly, I was able to show, in favour of a process-based approach, that previous studies which set 'culture' as a given external 'factor' and only examine its effects on occupational culture fall short. Secondly, I have extended the debate about the ship as a "social place" (total institution, heterotopia, hyperspace) by a critical postcolonial perspective.
