This is because of the proposal of the Commission for an amendment of regulation 17/62 with the change to legal exception on the one hand and because of the decision "Bernard Crehan" of the European Court in September 2001 on the other hand.The doctoral thesis at issue shows the foundation and the importance of an effective remedy in the national courts in case of infringement of EC competition rules and how effective judicial protection of Community rights and uniform application of Community law in all Member States can be optimally achieved. To exemplify the thesis and to make the relevance evident tender cartels are hold up as an example. |
