Item-typ:Veröffentlichung, Measuring Legal Segmentation in Labour LawThe Standard Employment Relationship (SER) in industrialised countries is associated with strong protection for employees who fulfil its criteria, but tends to neglect those who do not. However, comparative quantitative research in labour law so far has mainly focused on the overall level of employment protection in the North-Western Hemisphere. We ask how legal segmentation in labour law, i.e. the exclusion from and gradation in employment protection, can be conceptualised and measured in a global perspective. Drawing on leximetrics, a method to quantify norms, we make use of and extend existing datasets such as the CBR-LRI and EPLex. We identify three main functions of individual employment law in the protection/segmentation context: the standard-setting (S), privileging (P), and equalising (E) function. Assuming that the three functions are mutually independent, we develop the SPE typology - a typology of employment law models. Building on that, we sketch out a measurement concept that breaks the functions down into dimensions, aspects, and 36 observable indicators that are informed by specific legal norms. The SPE typology offers a genuinely new perspective for comparative labour regulation research, allowing a differentiation of SER patterns and path dependencies. The Worlds of Labour (WoL) Dataset(2025-06); This Technical Report on the Worlds of Labour Dataset (WoL) outlines the operationalisation of data collection and coding of employment law. The Wol covers 35 indicators measuring the evolution of particular normative regulations, seven indicators measuring and defining labour law types and functions, and one that dates back to the adoption of the first labour legislation. The historical period spans from 1880 to 2022, with a focus on countries in the Global South and colonial powers. The rest of the world is covered between 1970 and 2022, or from 1991 to 2022 for former communist countries. The focus is on the three major functions of labour law: standard setting, privileging, and equalising (SPE), with partial use of the leximetric labour law database CBR-LRI (Deakin et al. 2023a). The first part of this report describes general rules for coding the law. These Coding Instructions describe the coding objectives, principles and rules used for coding the Worlds of Labour (WoL) SPE-Index on the standard-setting (S), privileging (P) and equalizing (E) functions in worldwide national labour legislation. The second part, the Description of Indicators, contain the two template versions used, including coding instructions by variable for both WoL-SPE and CBR-LRI variables. The third part lists technical information on the countries covered by WoL, including sources for the introduction of labour regulation. This technical paper is complementary to the conceptional and theoretical articles concerning the database (Dingeldey et al. 2022; Carlino et al. 2025) and the theoretical background on legal segmentation (Mückenberger and Dingeldey 2022; Fechner et al. 2025). Analysiert werden neben den früh angelegten Grundstrukturen wesentliche Reformen bis 1973, der neoliberale Umbruch während der Pinochet-Diktatur sowie neue Impulse nach der Diktatur, um abschließend eine Einordnung der arbeitsrechtlichen Debatten und Richtungsentscheidungen im Rahmen der Debatten um eine neue Verfassung vorzunehmen. Rupturas y continuidades en la legislación chilena (1924–2022)(2023-09-29)El artículo esboza las principales etapas de la evolución del derecho laboral chileno moderno desde sus inicios en la década de 1920 hasta la actualidad. Además de las primeras estructuras básicas, se analizan las reformas esenciales hasta 1973, el cambio radical neoliberal durante la dictadura de Pinochet y los nuevos impulsos después de la dictadura, para concluir con una clasificación de los debates sobre el derecho del trabajo y las decisiones de orientación en el contexto de los debates sobre una nueva constitución en 2021/22. La atención de este trabajo se centra en el análisis de las dependencias de camino y los cambios profundos en su desarrollo, incluyendo las rupturas con los paradigmas convencionales de la organización y regulación del empleo dependiente en Chile.Wissenschaftlicher Artikel239 151
