The emphases of this thesis lay on the following: contract freedom and private autonomy; short history of court practise of contents control in both countries; the characters of the two key words AGB and standard terms; the personal and the objective application ranges of content control; limits of the contents control; comparative research of the control standards, in particular the general clause of gut faith; relationship between the contents control and conditional cartel and conditional recommendation; interpretation of AGB und standard terms; results of the ineffective terms; Verbandsklage and representative action concerning the content control; preventive control by executive power; content control concerning the international trade in the framework of CISG and four appendixes. |
